ILR FOR PBS SKilled Worker Dependent - Employment salary Query

Hi,

My wife main applicant is applying for ILR now in Jul 2024 thorugh Health care - Skilled Worker Route

Me and my kids will be applying ILR only end of Nov 2024 as our visas started in Dec 2019.

My wife is planning to reduce working hours after her ILR.
How does this impact dependents ILR process. Should the main ILR holder must be in full time job and meet any salary requirements for dependents to apply ILR?

Note: I am contracting and get my own payslips and PAYE salary and can get employment letter. So

1. Does me being in job is sufficient or should the MAIN ILR holder must also be working fulltime ?
2. Is part time / Contract job for my wife is enough to enable us to apply for ILR in Nov?

Based on you recommendations we will plan next steps.

There is no employment or financial requirement to meet for dependants. So your employment arrangments or hers are totally irrelevant. After her ILR is granted, your wife can work as she wishes without any effect on your application

have enough income to support yourselves and your dependants
not be using public funds


Any idea what constitutes as enough income? I don't think ILR would be granted when both are unemployed.

There is no specific requirement under the rules and never has been. GOV.UK often does not provide exact/accurate information as per the rules !!

ILR for dependents

Hello all.

By grace of god my wife got ILR this week.

Next step is to process mine and kids in couple of months.

1. Is the 28 days rule applicable for dependents too. Can we apply 28 days before the first stamp ? Or should it be 5 years fully completed?

2. I have plans to do mine in priority and standard for kids later once I receive mine. Will this delay us in kids meeting naturalisation requirements. ? I mean will the kids need to wait for 12 months after ILR for naturalisation. Or are they eligible when 1 or both parents get naturalisation.

1. There is no such thing as the 28-day rule. That is a historical concession that is applied to all ILR applications

2. Children do NOT naturalise, they get registered as British without a 12-month waiting requirement. Children born in the UK can be registered as British without securing ILR and can be registered directly after one parent is settled. Non-UK born children are expected to have ILR and can only be registered when one parent is British and the other one is at least settled.

My kids are not UK born. I will get them ILR in Dec. But in standard route and they might get it 3 months later due to standard route SLA.

As you said when my wife applies for naturalisation around next August 25 the kids can apply for passport too without waiting for 12 months after ILR.

12 months waiting for naturalisation is applicable only for adult dependent.

Am I right in saying this.

As I said, naturalisation is for adults. Children will get registered when they qualify and their qualification depends on their parents.
The British passport is only issued to British citizens, kids will have to first become British citizens before being able to get passports.

Your kids must hold ILR and your wife must become British first (naturalise and attend her ceremony) then you apply to register the kids using form MN1: https://visas-immigration.service.gov.uk/product/mn1

Hi,

My wife the main applicant received ILR in Jul 2024 from Tier2 / Healthcare Skilled worker visa route.

I am planning to apply for ILR in Nov 24 through PBS dependent route with following docs

1. English language proof - ECCTIS
2. Life in UK
3. Cohabitation proof for 2 years
4. Payslips - Mine (Dependent)
5. Payslips - My Spouses (ILR Holder)
6. My employment letter / Contract
7. Absence History in a letter
8. Bank Statements

I am planning to furnish my wifes payslips and my payslips for financial requirements. I will also furnish employment letter for myself.

Should I request employment letter for my wife too for my dependent application and submit? Or just the pay slips sufficient?

The rules for dependant ILR and main applicants are NOT the same !!!!!
No employment or financial documents are needed at all
