SOC Code Change Reporting - Graduate Trainee

Post by midhun3197 » Sat Aug 03, 2024 9:48 am

According to the Immigration Rules, the following exception applies when determining whether a new visa application is required due to a change in SOC code for employment:

9.31.2. The following exception applies to paragraph 9.31.1.(c):
(a) the person is sponsored to undertake a graduate training programme covering multiple roles within the organisation; and
(b) the person is changing to a job with a different SOC 2020 occupation code either as a part of that programme or when appointed to a permanent role with the sponsor at the end of that programme; and
(c) their sponsor has notified the Home Office of the change of job and any change in salary.

I was on a graduate training program under the 2121 SOC code for civil engineers and moved into an Assistant Project Manager role in construction after completing the program. My employer notified the Home Office via SMS before this change occurred, but my line manager instructed the HR team to keep the SOC code the same. I recently discovered that there is a different SOC code for Construction Project Managers. Should my SOC code have been updated and reported to the Home Office via SMS? My role does involve civil engineering tasks, so I am a bit confused. According to the rules, is the Home Office only concerned with job title and salary changes, or is the SOC code also required? This change happened a couple of years ago, and I am concerned because I have applied for an extension now. Thank you.

Skilled Worker Visa Cancellation

If my sponsor fails to comply with reporting requirements due to a mistake in reporting my SOC code change on the SMS, and I have an extension application currently pending with the same sponsor, will my application be refused because of this issue? If so, can the same sponsor issue a new Certificate of Sponsorship (CoS) for me to reapply from outside the country once they have resolved the reporting non-compliance?
