Question on behalf of a family member.
In 2017, my uncle's wife was granted a visa known as (Leave to enter outside of the rules) Observation: Spouse. Their two kids were also granted same visa (Leave to enter outside of the rules) Observation: Dependents.
Both kids were under 18 when they came to UK and now they are over 18 adults.
The issue is that Uncle's wife is unable to clear her Life in the UK test and English language test. She did several attempts but was unsuccessful. In 2022 they all completed their 5 years and supposed to apply for ILR but they applied for dependent extension because the mother couldn't pass her Life in the UK test and English language test so my Uncle has applied for extensions for everyone. The children's are suffering because of the mother.
The question is that the children's and mother are going to complete 7 years and by end of 2024 their visa is also ending. Since they are over 18 adults so can they apply for ILR independently or they have to keep applying for dependent extensions??
