Can children get ILR if only one parent has ILR

Hi

I am a skilled worker, I expect to get my ILR soon.
I have one child who was born outside the UK, he has not lived in the UK for 5 years yet. But next year he will have lived in the UK for 5 years. So he can apply for ILR.
My wife might not be able to apply for ILR (English language issue). In this case, can my son apply for ILR? only one parent (me) will be having ILR? So can he get ILR in this case.

No, your son can only apply for ILR when your spouse does. The Skilled Worker dependent visa rules are clear, that children qualify for ILR when both parents do (same time) OR when the parent who qualifies last applies. This is regardless of how long the child has lived in the UK, there is no minimum 5 year for children anyway. They simply qualify for ILR when the second parent does.

So what about the 7 years route? Can my son apply for ILR once he finishes 7 years in the UK (without mum having ILR)? Thanks

No he cannot. There is no 7 year route for children on skilled worker dependent visas.

Hi

My wife has to do English Language Exam as a part of the ILR requirements (skilled worker dependent visa). I found different English Language exams that can be considered.
What would be the easiest exam please?

B1 GESE5 and can be re-used for naturalisation if you go this way.
10 minute speaking and listening exercise, £150.
If you have been in the UK for a few years they should all be easy.

Attempt the Trinity College London GESE SELT at Level B1.
