More on Maintenance Fund !!

Hi All,

I already have the Tier1 general visa and am working in UK. Now I want to apply for the dependants Visa for my family who are in India. My earnings are in two parts:
a) Salary in India which gets deposited in Indian Bank Account.
b) Allowance in UK, which gets deposited in my UK bank account.

Now for maintenance funds requirement, I am maintaining the adequate amount in my Indian Bank account. My query is whether this is OK or I need to show the maintenance fund in my UK bank account.

Note that both the accounts were shown when I applied for my Tier1 visa.

Any clarifications in this regard will be highly appreciated.

yes you can but please note that you cant do a double counting. The funds should be sufficient not only for your dependents' requirement but for your requirement too

So, do you mean that I need to maintain £1600 x2 = £3200 for the two dependants and another £1600 for myself, i.e. in total of £4800 ?

Well if you have been in UK for less than 12 months then it will be 2800 for yourself + 2x1600 for your dependents.

If you scroll down on the same thread it says:
My previous answer is true if both applicants are outside UK.
When you apply alone you would need to show 2800
When you apply later for your wife you would need to show 2800+1600= 4400 funds available.

I have written confirmation about that from BHC.
I applied last week for my wife, got the dependant visa in 4 days
Sorry, what is the confusion here. Can you explain please?

The question is,
If the main applicant already has Tier1, and he is currently in UK, staying for less than 12 months, and the dependant applicant is outside of UK and applying for the visa, then

According to paragraph 196 of Tier1 General Policy Guidance
Since the main applicant is already in UK, the maintenance funds he needs to show to stay in UK is 800 GBP instead of 2800 GBP.

According to paragraph 31 of dependants policy guidance, maintenance funds he needs to show for each dependant is 1600 GBP.

i.e., 800 GBP for Main Applicant + 1600 GBP for his dependant.

Seems 2400 GBP, what do you say ?

This is because, in couple of places even for these situations you replied saying
2800 GBP for Main Applicant + 1600 GBP for each dependant
and since I am in the similar situation would like to get clear info on this.

make sure that your bank statements shows required funds for each day for last 3 months, if your funds is less than required for any day in last 3months they will reject the visa... so please ensure you have sufficient funds..

my HSMP is rejected because i haven't maintantined funds for one day in last 3months though my end balance is well more than required for last 3 months..

so it is not monthly they check every day balance

I got a reply from VFS after mailing them who told..

you need to show 1600 £ only per dependant.. i dont understand why you want to show mantainance funds for urself when u already have got ur hsmp visa and working in UK.. was the statement they made.

this message is to all those people who are pointing that the main applicant being in uk and working on tier1 hsmp has to show 800 £ which is not true.. its
just 1600£ for dependant applying from india ...

I was earlier on a workpermit for a year and switched to Tier1 visa in april 2008 within uk itself.. and my work permit was valid till 2009 april , but now Tier1 hsmp has superseeded it.

Yes, you are right, you will not required to show any funds. As long as you are able to show satisfactory proof for source of funds and has also maintained it in your account (Personal/Current) for three months, you will be able to meet the maintenance criteria.
