Visa rejected. How long grace period before we have to leave?

Post by ch15 » Tue Jan 20, 2009 9:53 pm

Hi all, I applied for Tier 1 (General) visa on 30 Dec 08 from the UK, but we think the application is likely to be rejected, because of 'insufficient' maintenance fund!

I saved £2000+ all three months in my account, except 1 day fell below 800 pounds (due to direct debit)!

I have not heard from them yet, but we have prepared for the worst.

Our current visa will end TOMORROW, I'm pretty sure by the time we receive the letter from them, our visa will be expired.

my question is is there a grace period (from the time of receipt the notification of refusal) before we have to leave the country?

we need time to sold our properties and goods before we can leave, I just wondered how long we can stay (legally) before we have to leave?

Any advice will be appreciated, thank you

I am very hopeful that you will get visa even if maintainence funds were down for 1 month (fingers crossed). Though if the caseworker decides definitely not to give you guys visa then I am afraid the grace period is anything between 15-28 days as per my knowledge. But I still think that many people got visa even without proper maintainence funds. Good luck

Be optimistic and I believe you would get your visa.....
What type of your current visa is? If it is extention, you can go for appeal and till your case is decided, you are legal in the country.

Rather in wrost case scenario (whatever type of visa you ahve), if your visa is rejected, and if I were in your shoes, I would go to an immigration lawyer rather than leaveing the country to get his opinion.....

See the excerpt from T1(G) guidance notes. (Page 35, First 3 lines)

the balance must always be at least £2,800 or £800, as appropriate.

If your current visa is expired and your tier 1 general application is also refused then you will be given right of appeal.

Lodge an appeal. Get a solicitor or legal advisor. Advise him to linger on the process.

Your will remain legal until or unless appeal is decided.

It could take 3-9 months in some cases even more to get the decision on appeal. Meanwhile you will remain legal in this country and do necessary arrangements to leave the country.

Hi, I was currently on IGS visa, presently expired. So, if I got rejected, I will have to leave! And I have read from other threads, a refusal due to applicant's mistake cannot be appealed! any thought?

I ONLY aware of that (> £800 in account everyday) after application submitted, so I am now preparing the worst scenario. I blame no one but myself, for being careless. Thank God I've got another good job offer from other country. It's just a great shame I have to give up my life here.

The thing is, I sent my application on the 30 Dec, and I have not heard from them yet, no matter good or bad outcome, keep dragging like that don't give any good to me.

Wish you folks all the best in the UK!
