When to Extend ?

Hi,

My initial HSMP is from 2005. My current visa will expire on Aug 2009, but we are going to India in July 2009 for 1-2 months. I want to ask if I can apply for extension around Arpil 2009 so I will get my passport back before we go to India ? Will they accept my extension application 4 months in advance ?
I got my last extension in Aug 2006 so my current visa is still HSMP and it has to be changed to Tier-1. I think in this case I can send my application any time. Please confirm.

I will complete 4 years in April 2009 (all working here). After the new JR hearing on 13th March I may be eligible for ILR in 4 years OR I may have to wait 1 more year. so there are chances that if apply in April 2009 I may apply directly for ILR and not extension ?
