HSMP (or Tier 1): Termination of employment question

Could someone tell me what happens if a Tier 1 visa holder loses a job. Is there a grace period during which he/she has to find another employer? What happens if one does not find a job within the grace period?

If you're a T-1 visa holder then you are not tied up to a 28day clause whereby you need to seek another employer just like in old WP system ot T-2 nowadays.

Even if that is the case, and I stand to be corrected on this one, long period of unemployment may hamper your chances of getting an extension if you need one.

Katya, there is no grace period involved in this scenario for the Tier 1 scheme. If you lose your job and you are on a Tier 1 visa, you can remain in the country as long as your visa is valid in order to seek other employment.

The problem may arise during your renewal of Tier-1 as you may not have enough earnings points to qualify for the scheme when it comes to extending it.

If you are on tier1, then you have full access to the UK labour market without any time restrictions for finding a job. But ofcourse, you have to go though, again unfortunatly, from the same process of scoring 75 points and maintenance for your extention. 28 days rule is for Teir 2.

Important point to remember. If you have obtained HSMP before nov 2006
and extended under Tier 1 general , you can get extension again under old HSMP rule to reach qualifying period for ILR.

Say if you have got your hsmp for 2 years before nov 2006 and then got for exteneed under Tier 1 general (before JR rule came to effect).

If you are out of country or some reason and not able to meet 5 years residency requiremet for ILR. you can again get one more extension under JR rules.
