Hello,

I have applied for the extension of my HSMP under tier1 on 12th december 08. I havent got the result yet. Its taking very long and hence in the meantime I have decided better to prepare for any (favourable or unfavourable) outcome.

In the event of it getting rejected, I believe I will have the right to appeal. Can anyone advise if its advisible to lauch the appeal on your own or is it better to do it through an immigration solicitor? If through a solicitor, then does anyone know names and contact details of any good solicitors with proven track record?

Hi

Don't count your chickens before they hatch...and wait for the decision from HO.

I would suggest that in worst case scenario, go to immigration solicitor and lodge an appeal. Prepare your points based on the rejection arguments. You can find the list of laywer through net or Yellow pages or someone from this forum can help you who has some experience about lawyers.

priya_bhosale,

why do you think they will reject your Visa.. in my case i was scared as i did not declare in driving conviction in initial application... (but declared afterwords.) i applied on 28th Nov 08.. fees charged on 1st December.. got my approval on 24th Jan dated 22nd Jan.. best is to speek to HO or send an urgent treatement email request.....

Hi, if you haven't done anything wrong with your application and you are qualify, I don't see there is anything you have to worry about it.

I saw from another thread (namely Dec 08 application timelines), one guy waited 2 months to get the approval last week, not because there is problem in his application, it's just a busy period last month, I'm sure HO is overwhelmed with application packs!

For my case though, I submited my application on 30th Dec, but I've now prepared the worst, because my maintenance fund fell below 800 on one day. And I doubt I can appeal for that.

Thanks for the replies.

Like I said I was just wanting to be prepared IN CASE it gets rejected. Because I think they give you 10 days within which you can lauch an appeal. As I thought 10 days is a short time hence I decided to keep the course of action ready so in case it gets rejected, I dont have to waste anymore time in making the arrangements for appeal.

And congrats nksg for getting the visa! Did you send urgent treatment request for yourself? If so, could you please tell me which is the right form for it?

Hi, IF you are given right to appeal, that usually has to be done in 28 days. Otherwise, you are given 28 days (some say 15) grace period to leave the country.

Yes I have, many times. The last time I rang was today and the reply was the same...application still under consideration!

I think we all need to apply urgent treatment.

The 0870 number that BIA has is nothing but a money making machine for them. They have no useful information and they do not answer you with any customer service motive either. I am now waiting for more than 2 months and have been hearing the same update for the last 4 weeks. They have no reason for delay, which is even more frustrating!!

That seams to be a good idea.. but HO is very strict on UT forms.. and now they are asking for some evidance... so if you have genuane reason and some sort of document supporting it .. just do it.. i just took my chance....

As good as urgent treatment forms are, you still need a reason for urgent treatment. Sadly, "impatience," is not a suitable reason... :?

Yes, we should be entitled to work and live till the outcome arrives.
If the opportunity doesn't knock, build a door.
