Is there any such Rule ? Seniors Please Reply

Post by harryy » Sat Feb 07, 2009 11:58 am

Is there any such rule that If you travel to UK within 28 days of Visa start date, then you need to apply for second extension after spending five years in UK.? You can apply for ILR directly.

If you travel after these many days than you will have to take another extension.

Seniors please reply.

I did'nt fully understand your question, but your ILR count starts from the day you have entered the country. (Infact on the application form, it will ask you to specify the date from which the ILR count to begin , ie., the date you have first entered the country on the visa that you are applying for ILR)

During the ILR count (5 year period) some absences are allowed for example up to 90 consecutive days or a total of 6 months absence in the 5 year period.

Well, ofcourse at the end of your current leave to remain (on HSMP), if you do not qualify for ILR based on the above rules, then the only choice is you will hae to apply for an extension. You will do this until you qualify for the ILR rules.

Hope this answers your question.
