Claiming Housing Benefit and applying for wifes visa!!!

Post by Mohammed Qadir » Tue Feb 10, 2009 8:22 pm

Hi, my brother who lives in here in the UK, and has lived here since he was born, is going to get married in a few weeks in pakistan, he has a steady job working 30 hours a week, earns about £10k a year, but what he would like to know is that he claims housing benefit (he rents a house) and that if he applies for his wifes spouse visa will it be refused because he is claiming it or will he be ok because he is entitled to housing benefit because he is settled here??,

please anyone reply to whether he would be ok with this,

thanks.

What is his UK immigration status? Is he a British Citizen? Or have ILR?

How would he have ILR after just 4 years? ON what basis did he get that?

Has ILR

He was brought over here on a spouse visa himself 4 years ago when his ex-wife applied for him, after he got his ILR after 2 years, relations between his wife became tense due to massive family problems on both sides so they divorced, and he is now single and living alone on rent.

As he has ILR he is allowed to claim HB. But he needs to do a monthly budget to show that his wife will not need to claim certain Public Funds.
