Refused on the basis of over work??

Post by callraheel » Tue Feb 10, 2009 10:20 pm

Hi there,

Anybody in here who applied for student visa extension and got refused or know someone who got refused because he/she has worked overtime. As they ask for NI Number on the form I just wonder if they refuse or possibly ban someone from applying in future if they have done full time work during term time on their visa.

I am concerned about it as I have done some full time work in past months during term time. Though I was also studying full time (never missing any lectures) but at the same time done extra work. I have my extension coming in August and i am worried about it.

Please advise about it.

Many Thanks,
R

It is possible your application would be refused if you worked full time during term time, particularly if it is over a long period of time and a lot over 20 hours.

There is every chance they will query your earnings if it is obvious that you have worked more hours than 20 per week during term time.

It all depends if they have enough information to query the point. If you have worked for an employer that has declared your earnings then there will be a small chance of discovery if you only worked a couple of extra week’s full time. If you worked for a major employer for several months on a full time basis it will show up fairly readily if / when enquiries are made.

The employer has a lot to lose as well - a fine of up to £10000 for employing a worker in breach of their visa conditions.
