Subject: Fwd: Regarding extenstion of leave to remain under Tier 1 for existing HSMP Holder: early application

- Show quoted text -

Dear Sir/Madam,

I am residing in the UK under the Highly Skilled Migrant Programme and my current leave expires in November 2009.

Due to employment reasons, I wish to apply for extension earlier than the planned date by about 6-7 months, i.e April or May 2009.

I request you to kindly let me know if it is permissible to apply for further leave to remain under Tier 1 General Highly Skilled Migrant Category six or seven months before the expiry of the current leave?

Your guidance will be highly appreciated.

Thanks and regards,

xxxx

Early extension query

Post by rkrohela » Sun Feb 08, 2009 10:39 am

Hi,

Atul, when you applied 2 months early, did they issue visa to you after expiry of current leave or did they issue it with immediate effect?

I had recieved the HSMP approval on 02nd February 2007 and my HSMP Visa expires on 21st March 2009.

I am applying for extension, can you please provide me with application form version/reference number so that i am sure that i am using the correct application form?

Current i have following form APPLICATION FOR AN INITIAL GRANT OF LEAVE (SWITCHING) OR AN EXTENSION OF LEAVE UNDER TIER 1 (GENERAL) MAIN APPLICANT (Version 11/08)

Secondly, do i need to submit seperate application form for my spouse who is an dependant? Atleast thats what above main application form says?

Appreciate your inputs

Just take the latest form from BIA website for yourself (from http://www.ukba.homeoffice.gov.uk/worki ... gyourstay/) and your dependants (http://www.ukba.homeoffice.gov.uk/worki ... ependants/ ).

Also look at maintenance funds requirements at http://www.ukba.homeoffice.gov.uk/worki ... entofunds/

FLR Tier1 (HSMP) Under JR
Sent application Jan 23 2009 (Friday)
Received by HO Jan 26 2009
Fee from debit card - Jan 27 2009
Ref number Letter - Jan 28 2009. Ref N0 -PB3313
Approval 17 Feb 2009
Received documents 20 Feb 2009
Previous visa was from 1st March 2007 to 1st March 2009.
Extension to 1st April 2012
No urgent treatment sent.

My initial visa started on March 1 2007, expires on March 1 2009. I entered the UK on April 1 2007 (one month after visa started). I requested in my cover letter for extra 28 days so I would not need a furthur extension to meet 5 year ILR / probational citizenship. My extension visa was granted to April 1st 2012 (3 years and 1 month).

Documents sent - P60, P45, 12 months bank statements and payslips. Cover letter (cover letter had monthly breakdown of gross and net salary, and pay dates to bank). I have no dependents.

The part of my cover letter requesting extra days on the visa is pasted below:
------------------------------------------------------------------------------------
Please kindly note the following:
As stated in the HSMP Forum Limited judicial review policy document (9 July 2008), for migrants covered by the judgement: If an applicant meets these requirements we will grant them:
a. Three years’ leave; or b. Enough leave to enable the applicant to complete the qualifying period for settlement,
whichever is the greater.

I entered the UK on 1st April 2007, 30 days after the start of my HSMP visa (01 March 2007). Therefore I would need an extra 30 days on my three year extension to take me to the current settlement qualifying period of five years. My extension period (under HSMP Forum Ltd, JR Policy Document) if granted, should be at least 3 years and 30 days.

--------------------------------------------------------------------------------
Hope this helps.

General Tier 1 help

Post by nimophone » Tue Feb 24, 2009 12:39 am

Hi All,

I came to UK on HSMP visa in 2007. My HSMP visa is valid till 20th may 2009. Planning to apply for the extension in hurry after Ms Smith yesterday. Some quick answers will help me sail smoothly in the disturbed waters.

1) Section 3 - Tier 1 (General ) Details
A) Is the applicant making an application for:
An initial grant of leave to remain (switching) under Tier 1 (General)
- go to question B)
An extension of leave within Tier 1 (General)
- go to question C)
(This includes any in-country applicant whose last grant of leave was made under Tier 1 (General) or under one of the following categories: the Highly Skilled Migrant Programme (HSMP); the Self-Employed Lawyers Concession;

For this question do i have to tick "An Extension of Leave within Tier 1 ( General ).

2) Bank Statement. My Lloyds TSB Account is spanning across 35 Sheets for Period Between 01Feb 08 to 31 Jan 09. Can i only include pages having "Bank Giro Credit" i.e salary Credit from my employer.

3) Do i need to send my Bachelors Degree Certificates as an evidence for Qualifications or Only last time's HSMP will suufice this.

Might be a naive question but giving me jitters for last few hours.

Kindly help me in securing my Extension.

Nimo

extension processing time

Post by bodyguard » Tue Feb 24, 2009 8:07 am

I applied for Tier-1 extension (i was on HSMP non-JR) on 10th jan. cc was charged on 12 jan and i recd letter from bia dated 12 jan. i still haven't recd my extn yet. yesterday (23 feb), i called up bia. they told me its in the queue and has not been assigned to a caseworker yet. they were not sure when it will be processed and asked me to continue waiting.

so, for non JR extension cases, they are taking more than 6 weeks.

another friend, who applied for extn under JR category, recd his visa back in 4 weeks.

1) i dont remember how i did it

2) why do u want to save pennies on postage by not sending complete bank statements? why do u want to give them any chance to reject ur application?

3) there is no need to send bachelor degree again, if u sent it during initial hsmp application.

Arti
JR = Judicial Review

initial hsmp application before 13-dec-2006 comes under JR category.

initial hsmp application after 13-dec-2006 comes under non-JR category.
