Switching from HSMP Dependant to Tier1

Hi All,

I have been in the UK since January 2008 on HSMP and my wife is on a HSMP dependant visa.

I have some queries about my wife switching from HSMP dependant to Tier1.

1) Is it possible? Or will she have to apply as a Fresh Tier1 applicant?
2) In either case, would she have to go back to India for applying for the visa, or can it be done from here?

I look forward to advice from people who might have had first hand experience of this issue.

Dependents of HSMP cannot apply for Tier1 or any sort of VISA being in UK. I think your wife would need to go back to India and apply a fresh Tier 1 Although I am not sure if her earnings (Being a dependent on HSMP) would be considered to fulfil the criteria.

I agree with the previous post. Depends will have to apply from their home country for Tier 1 application.
