Can i claim pay for 10 months out of my last 12 months ?

Hi,

I am applying for new HSMP in month of March from India. I have one question with my previous earnings for a period of 10 months in the last 12 months by doing that I can claim sufficient points to get eligibility?

Is submitting last 10 months payslips allowed or not?

The reason I want to claim only 10 months is I have changed company around 10 months back and don't want to show my earnings of previous company. Please suggest me the feasibility of this approach?

if these 10 months are giving you enough points for eligiblity then of course you can.
Thinking low is crime....

Thank you very much for your reply and for the time you have spent answer my question.

I have few more specific questions that is the reason why I am sending you private message.

1) In Pbsappendix1 form it was stated that "You can claim points for Previous Earnings for any single,consecutive 12 month period from the 15 months". If I submit only for 10 months won't it b a problem.
2) If I claim previous earnings points for 10 months shall I insert that period for which I was employed in the current organization.

Please could you help me with your suggestions to my queries?

Hello Suresh,
It is recommended that you follow the rules exactly as of today. Since any deviation would result in rejection, loss of 600 pounds and waste of time.

Hi Suresh,

I would recommend to follow the guidance religously. Although you can show the 10 months salary to get the sufficient points, its better to provide 12 months details to assure HO that you were employed for 12 months.

10 months will be fine, as long as you can demonstrate sufficient points with 10 months alone.

For example, if you were claiming for the period between Feb 2008 - Feb 2009, and you did not work in Feb 2008 and March 2008, but still earned £30,000+ (for example) between April 2008 and January 2009, then you can claim enough points for the entire period regardless of the fact that you did not have earnings for every month.

just to give my experience, i first applied with 10 months salary.. which was enough for 75 points... didn't have any problems...

My Tier-1 application was successful and I claimed only 9 months.
I applied in first week of Dec-08 and provided salary slips & bank statement for the period Mar-08 till Nov-08.
