Absence UK days: 180 or 225 for Tier1 holder applying ILR

Post by Gob00st » Fri Feb 27, 2009 5:37 pm

Hi,
I have been reading thread regarding Absence days allowance.
Some claim it is 6 month (roughly 180 days),
Some claim it is 225 days.

And also one single trip cannot exceed 3 months(90 days).

Could anyone please gimme the definitive answer and point the valid source link if you have it.

Many Thanks.

180 appears in the formal guidelines for a case worker. It hasn't been updated since the ILR eligibility changed from 4 to 5 years. However, HO will probably consider 225 days in applications (some people have asked the HO and got that answer) though it is not official yet.
The absences criteria is more at the discretion of the case worker.

As for the single trip - there is no doubt about that requirement. You will most likely get your ILR refused if you have a single trip for over 90 days!

Hope this helps and Good Luck!!

2 years. The details can be found in para 319E of the immigration rules.
