loosing job/claiming benefits

Post by Nazz » Wed Mar 11, 2009 12:49 pm

Dear All

Due to the fact that we are going through this economic uncertainty, a job is not guaranteed anymore.

Question:

What if a sponsor (ILR status) who has a wife (on marriage visa for two years) looses his job, can he claim benefits?

Obviously the wife can’t claim benefits as her residency permit states that no resource to public funds.

So can the sponsor claim benefits till he can find another job?

I did ask a lawyer and he told me that I can claim JSA for myself and not Housing benefit because wife is living with me, how true is this?

If you do not have any child, I don't think you can apply for housing benefit. Your wife is not entitled to housing benefit.

You don't need to have a child in order to claim HB.

Hi Nazz, I have asked someone who was in same situation as yours..

Wife used to get JSA while husband was on 2 years spouse visa and they had no problem at all.

You can claim all benefits on your name and should not have any problem.
Arrived UK in Dec 2000, Received ILR Oct 2008, Citizenship Approved March 2016.

you should not claim 'more' of a benefit becuase your wife is there.

So does it mean that i can claim housing and JSA if i loose my job? so if i apply for housing benefit, it should be under my name and should not include my wife, is that true?

I dont know why the lawyer told me that i should not apply for Housing Benefit even under my name, so strange.

Thank you all for the feedback

I am telling you what i was told by friend. I am not sure about housing benefits but she was claiming JSA as well as WTC on her name.

Some one must know the answer to my question? If a sponsor looses his job, and if he claims housing benefit, will this have negative effect on his wife's 2 years residency upon renewal?
