ILR on work permit - 4 yrs or 5 yrs if HSMP forum wins?

Dear All

I have been on work permit since Oct 2004. However, I switched to HSMP in August 2006. Could anyone clarify what happens if the HSMP forum wins their case. If the requirement for ILR for people who joined HSMP scheme before April 2006 comes back to 4 years, would that affect people like me.

If yes, I would be eligible for ILR now, if not, I would have to wait till March 2010 (I had finally got my first FLR in March 2005). This just means keeping your fingers crossed all that long, that home office does not extend the ILR requirement again in that time.

Although I switched to HSMP after April 2006, but I was on Work Permit before that.

Also, would anyone have a copy of the Work Permit scheme for 2004?

How come you started working (if I am reading correctly) before approval of your FLR?

I was on student visa before that valid till Nov 2004. I was informed by my solicitor applying on my behalf, that as long as I have appiled for new visa before the expiry of the current one, regulations of the earlier one will apply. Student visa stated that I could work 20 hrs a week during term time and full time during holidays and other non-term time as long as my visa was still valid.

So I was allowed to work while my passport was with home office from end Oct 2004 to mid March 2005.

Forgot to add,

For ILR purposes I am told, the calculation of 4/5 yrs would start from the start date of my visa and not WP.

ILR changes came into effect in April 2006. you wont' be eligible to apply in 4 years. Hope this helps

Does that mean that me being on Work Permit prior to April 2006 would not make any difference.
I am trying to find out what was the requirement for ILR if you were on Work Permit.

My wife is on work permit holder. She came to UK in Septemember 2004. On the back side of her work permit, it is mentioned that after continuous stay of 4 years she can apply for ILR. But the rules are changed in April 2006. So we need to wait till August 09 to apply for ILR.

I was here July 2002, I supposed to be eligible July 2006, but they change the rules April 2006, so i waited another year. That's fine now as I already got my UK passport.

Workpermit holders already lost a judical review (filed by VBSI) for ILR 4 to 5 years change. The reason is that they haven't been promised ILR after 4 years regardless of any futures changes in rules.

For the people who entered HSMP before April 2006, the guidance offered this protection. The current Judicial review only covers HSMP holders came before April 2006. Hope this helps.

Is it true that HSMPians, who got their approval letters between april 2006 and november 2006, are not covered by JR in the sense that they will be able to apply for ILR after five years according to the rules of the original scheme?
