I think it will take at least 2 weeks for a decision to come out from this hearing.

I just went to the court to see how it was going, but it was totally full and they wouldn't let anyone else in.

Hopefully someone who is there will report back later!

just keeping my fingers crossed.. do any one know.. who will be eligible in this (apologies if answered already)??.

I was on 5 yrs WP from July 2004 - Feb 2005

was out of country for 94 days :( (Change of employer)

and then May 2005 - Jan 2007

Though i was approved under OLD (JR) scheme... approval letter issued in August 2006..

The Hon Mrs Justice Cox DBE

The Hon Mrs Justice Cox DBE was appointed as a High Court Judge in November 2002. Before her appointment she had been the Head of Chambers at Cloisters in the Temple, where she specialised, wrote and lectured for many years in discrimination and employment, European and human rights law. She was appointed Queen’s Counsel in 1994 and was regularly named in legal directories as one of the leading practitioners in equality and employment law, appearing in many of the leading cases in both domestic and European courts. In December 2002 she received a lifetime achievement award from Liberty and JUSTICE for her commitment to equality and human rights.

In 1998 Laura Cox was appointed and continues to serve as the British member of the International Labour Organisation Committee of Experts, monitoring ILO Member States’ compliance with international labour standards. She chaired the Bar Council Sex Discrimination Committee and, subsequently, the Equal Opportunities Committee and in 2003 she was appointed as Chair of the Equal Treatment Advisory Committee, the advisory committee to the Judicial Studies Board on equality and diversity training for the judiciary. She was, from 2001 – 2004, Chair of the Board of Interights, the international human rights organisation established to promote the effective use of human rights law to protect rights and freedoms world-wide, in co-operation with lawyers, NGOs and judges. In 2005 she was delighted to be invited to become the Honorary President of the Association of Women Barristers and she is currently a committee member of the UK Association of Women Judges.

The Judicial Review Hearing took place on 13th March 2009 and our Barristers did an excellent job. Our leading Barrister Michael Fordham, QC left no stone unturned. We are confident of a positive outcome. The Judgment should be announced shortly. We will update once we know a judgment date, which should not take long.

will this judgment about ILR be helpfull for HSMPIANS after 2006? what i mean is, will this judgement stop any retrospective law in future? even if HO loose this time, they still can make new retrospective rules in futre for HSMP holders who came after 2006? is it? if thats the case then i think there shoudl be another judicial review just to stop HO's retrospective rules. no other country in the whole world, makes retrospective rules for immigrants. its unfair and totally breach of human right.

Yes you are right, it is not fair to change rule every now and then. We have to stand for our rights,

Unfortunately, unlike pre Dec 2006 cases you applied with an express undertaking that further applications/extensions etc. will be subject to rule sthen prevailing, which could be different from the rules in existance on the date of original application.

So what do u reckon to people who got HSMP between April 06 and Nov 06?

Will we be ensured ILR after 5 years no matter what happens to the rules?

I am in Uk from feb 2005 on WP and became HSMp in 2007 only . So will this CASE or OUTCOME FROM JUDICIARY help me or it is only for HSMP guys ONLY ?


What i mean is when i came in 2005 FEB on WP , ILR was 4 years and they changed to 5 years in 2006 . So as per logic , guys who came before nomatter HSMP or WP , it should still hold 4 years .
