New rules on Tier-1 General Starting Date(Mar 31 or Apr 6?)

New rules on Tier-1 General Starting Date(Mar 31 or Apr 6?)

According to the recent statement of changes HC314 http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary
Under section 4.3 of Explanatory Memorandum, It was mentioned that

4.3. The majority of these changes to the Immigration Rules will come into force on 31 March 2009.
The changes relating to allowing certain applications under Tier 1, 2 and 5 applications to be
made at Public Enquiry Offices will come into force on 6 April 2009.

Also, it was mentioned that

The changes in paragraphs 7 to 9 shall take effect on 6 April 2009.



After reading this, I am a bit confused on the date on which the new rules will be applied.
Can anybody please let me know whether the new rule - “Migrants applying for their first period of leave under Tier 1 (General) will receive no points for Bachelors degreesâ€

"Migrants applying for their first period of leave under Tier 1 (General) will receive no points for Bachelors degrees"

Can this be interpreted as :-

Migrants applying for their second or third period of leave under Tier 1 (General) will receive points for Bachelors degrees

Extension questions ??

Yes, for extension of Tier1 (as per the current rules) the applicants will receive points for Bachelors.

What is the new visa start date?

My current HSMP visa will run out in July 2009. If I apply before 31st of March then I am wondering that did they extended my existing leave to remain from the date of expiry of old visa? I mean the start date of new visa will start from the expiry of old one or from the date it was stamped?

I am thinking in terms on ILR requirement.

I really appreciate your kind help.

The final decision of stamping/ renew of the new visa et al.. are all at the discretion of HO..
