Informing Change of Circumstances

Hi,

I recently applied for HSMP under Tier 1 on 27th Jan 2009 from UK and currently awaiting for a decision.

In meantime, the company I worked earlier has gone into administration as a result I've lost my job and all this happened after I applied for Tier 1 (Switching from WorkPermit).

Previously I was on a work permit valid until Mar 2010 and wanted to switch into the Tier 1 category after I heard things could wrong with my employer.

I'm confused & worried since after I heard from my old employer (Currenly in Administration) that UK Border agency have called them asking for reference and they have said that the company is no longer !

My question is whether I should inform UK Border Agency of the change of my previous work circumstances, as I've lost a job right now?

Will it hinder my application process?

Does the accessing officer award points based on history (previous earnings, qualification, Age, Uk experience) OR can they consider what has happened to me situation after applying as well?

Your reply will be much appreciated since I believe my application is in process as I write !

I am sorry to hear that you are in such a situation.

I reckon you should use the change of circumstances form to inform HO. This is more imp now as HO had called your employer. I believe the application date or the period claimed for income is well before the date your company went in administration.

Hi ,

Hope your earnings were and proofs submitted is before the date the company went OFF .

So logically you have no problems , so when they called your company what did they say , depends on that .

If they said that "Yes he was working with us and the salary claiming is what he earned when th company was operating " --> Ok

If they said like " This company dont exist from long etc etc and some sort of vague answers . Then it is problem"

Usually they call employer when they see some stange stuffs on th earnings .

So if it was genuine , better let HO know . It is not your fault that the company goes for a toss . But always inform them .

Hi

Please inform UKBA as quickest as possible. Fax the change of circumstances form explaining everything. Its very important. As per guidence note, they are just interested in earnings.
Thinking low is crime....

Hallo Everyone,

Thanks for your valuable comments. I've downloaded the Change of Circumstances form but could someone guide me which section should I use to inform that "The company worked for has gone into adminsitration" ?

My previous earnings & work permit is genuine & valid until the company went into administration - hence I don't see any faults & clearly applied 2 days before the company lost business !! (Does that help ?)

I find only section that is more relevant is Personal Details - But under guidance notes it reads that Change of Personal are as follows... "Name Change" OR "Nationality Change" OR "New Passport Details" !

Also could someone give me the fax number for the UK Border Agency when applying within UK ? (Because the form says please send only by POST !)

Btw, could someone guide me on what exactly can I write to say that the company I worked for has gone into administration ?

I believe the according to the guidance notes, one does not need to have a job or job offer while applying for HSMP Tier 1 and the points are based on previous earnings & experience.

In my case all details submitted until the date of the application is valid and genuine !! (Hope it doesn't hinder my application?)

Anyway as recommended by you guys, I wish to fax & post the change of circumstances today.
