**ILR - 5 yrs from WP approval OR FLR(IED) stamping ?**

**ILR - 5 yrs from WP approval OR FLR(IED) stamping ?**

Help required to ascertain ILR qualifying dates - my situation as below :

Workpermit + Tier 1 ( General Migrant )

Workpermit application applied January 2004 whilst on visitor visa.

Visitor visa expired February 2004

Home office took nearly 7 months to approve – WP finally approved on 23rd July 2004 for 48 months ( rule that time was ILR in 4yrs )

FLR ( IED) visa stamped on 27th October 2004

Tier 1 ( General Migrant ) Visa stamped on 25th July 2008

Since my initial workpermit was approved on 23rd July 2004 – will my 5 years start from this date or will it start from the date I received FLR ( IED) ..i.e. 27th October 2004 ?

As per ILR criteria , one needs to stay legally for 5 years ( if in WP /Tier 1 /HSMP ) - will I be able to apply for ILR 28 days before my initial workpermit approval date ( 23rd July 2004 ) OR 28 days before my FLR (IED) stamping date ( 27th October 2004 ) ?

I think its at FLR(IED). you may need to check the archives cause i think this used to be discussed a lot a few years ago.

Sorry for jumping in. I am not sure but I think it will start from the date of entry. Isn't it?

Not quite cause he/she entered as visitor and then changed status 'switched' after making an in country application. This is going back to the good old days when you could come as a visitor, get a job, get workpermit and change leave to remain without having to return to home country
