When can I apply for Spouse Visa Extension?

When can I apply for Spouse Visa Extension?

I have searched around but couldn't find a definite answer.

My current spouse visa runs out Jan 2010 and I entered UK on Oct 2008. I am wondering can I apply for spouse visa extension now or must I wait until just before my visa expires?

So was your spouse visa issued in January 2008? You entered 10 months later? If so, you'll have to apply for Further Leave to Remain - FLR(M)
to fill the gap as you can't apply for ILR until 28 days prior to the 2nd
anniversary of the date you entered (Sept 2010). Apply for FLR before your visa expires, they won't accept the application yet.

I meant to ask about the 'spouse visa' extension - I know I cannot apply for ILR yet.

I'm looking for jobs now but with a 9 month visa it looks a bit difficult! If I can extend my spouse visa and get a 27 month extension I guess I'll stand a better chance in jobseeking?

You can't apply for an extension - FLR(M) until the month before your current visa expires.

If you're not convinced I've given the correct information, phone the PEO appointment line and ask to book an appointment to extend your spouse visa that doesn't expire until 2010, and they will advise that you are unable to do so...but at least it will give you confirmation.

:?: i think you can apply for FLR anytime you want, it doesn't have to be 30 days b4 your visa expires, i appled for FLR months b4 my misses via expired.(not unless they changed the rules recently)

but i think if you apply for FLR now, they will probably only extend it, til you've been in the UK 2yrs (10 months?) not 27 months !!!
