student visa extension refused and not liable to appeal

Post by andie » Tue Mar 17, 2009 12:22 am

Hi,

My bf has been a student in this country for 8 years. He was doing ACCA but because he wasn't passing his courses, he changed it to a business degree.

Now, home office sent him a letter saying he has to go home as soon as possible and that he has no right to appeal. The reasons where that during 1 year he didn't pass a single paper in ACCA (he showed that his parents passed away consecutively that year as well) and that he was working more than what he should in his part-time job....therefore they were not satified with him.

As he has been in this country for 8 years and he has ties, like he has payed all his university fees, incluidng the last year (he is finishing his second year), he has a loan from the bank and all his family members are EU citizens (most of them are british)....is there anything a solicitor can do at all? in the paper says no right to appeal, so this bit scares me...as it sounds very definitive.

Any help would be great.

Dont think so you can do anything, you can try human rights grounds for appeal.

Solicitor can definitely challenge that decision. U should get a good solicitor and apply cuz they can't take the right to appeal...
