Whether we are eligible to apply for ILR in person

In terms of the guidance for application for ILR on page 4 following is mentioned:

"The premium service is not available for applications as a businessperson, innovator, investor, self-employed lawyer, Tier 1 migrant or Tier 2 migrant."

I have seen a number of posts on this board where applicants as HSMP have applied for ILR in person. I have applied for HSMP ext under JR and stamp on the passport states "Tier 1 (General) Migrant". Do you think that we would be eligible to apply in person?

I guess this is a new premium service they are starting from 06-April-2009.
Best thing for you to do is call UKBA and find out if they can book your ILR appointment for Premium service.

Sten - you need to read the guidance again. The rules allowing HSMP/Tier 1 holders to use the Premium service come into effect from the 6th of April and do not end at that date.

The section that describes fees for ILR excludes PBS:

Table (a) - Fees for applications made in the UK
Applications made in the UK – outside Points Based System
Indefinite Leave to Remain in
the UK - Application made at
Public Enquiry Office (PEO)

I would be happy to be wrong though ..

You are right, the Premium service comes into effect from the 6th of April, but it applies to initial applications / extentions only, not SET(O) ..

The link you provided does not say anything about ILR for PBS it just shows the fee for ILR postal and PEO. So I am a bit bewildered about where you are getting your information from. The current (as issued in November 2008) guidance notes do not exclude HSMP so we can only go by that until new guidance notes / forms are issued and then we would go with whatever they say. My opnion is that it is more likely that Tier 1 will be included sooner rather than later, this is based mainly on the fact that FLR for these is also being introduced for these in April and to be honest I think it is more difficult to process an initial application of a pbs application than a ILR of the same

You are right it is a mess. That is why someone was suggesting that when you call to book your appointment you sometimes get different answers depending who you speak to so at times it is better to call back and hope that someone else picks up the phone and applies the 'requirements' correctly'.
Interesting that the website contradicts the guidance notes. That page on the website does go back quite a few years if i remember correctly but there seems to be many pple who have gone on to apply based on the forms and guidance notes. So when applying or phoning make sure you have the latest copy of the notes and be ready to quote to the phone operator or caseworker

Guys i called about this Long back . All my freinds already have appointment for tier 1 in april . How will they give appointment if they know HSMP - > tier 1 not possible

This is a OLD news as per HO guys . I called them some days back .

Somebody else can also confirm with HO what i said is true .

This sentence doesn't mean people under Points Based System cann't apply ILR at PEO. It just means the ILR is not part of Points Based System. SO ILR application is categoried as outside Points Based System. It make more sence if you read it in context. there is other catogory before it, like application in-country, out country, etc.

Well, what a difference a day can make!
This is the latest policy guidance on the UKBA website page 4 - section 12:
Put simply - Tier 1(G) can aply for ILR in person at the PEO.

12 APPLYING IN PERSON
We offer a premium service to people who apply in person
at our Public Enquiry Offices (PEOs). This service is
available only for applications which are straightforward
and do not require further enquiries. The premium rate of
£1020 has to be paid for this service - plus £50 per dependant
if any are applying with you.
The premium service is not available for applications as a
businessperson, innovator, investor, self-employed
lawyer, Tier 1 (Entrepreneur) or Tier 1 (Investor).
