HSMP Approved!! Guidance needed

Hi

I had applied for HSMP in Nov 04. Since my student visa was expiring in Dec 04 I had to send my FLR application before the student visa expired.

My Nov 04 application was refused recently and was awarded 55 points only.I then made a fresh application which has been approved.

My original FLR filed in Dec 04 is still with the Home Office.

Can I request HO to grant me FLR based on the approval I have received?
(HO may take a view that since my HSMP application of Nov 04 was refused I was out of status and hence I need to go back to my country and apply for EC)

Are there any points that I can put in my request for FLR - such as by being in UK I have to look for jobs etc etc

As regards switching from within the UK I fall under the rules where I am allowed to because I have graduated.

Any opinions, expert comments will be welcome.
