spouse visa from hong kong

Post by ortkyq » Wed Apr 01, 2009 3:03 pm

hi everyone,

my fiance is from uk, has a full british passport. we have been together for 4 years now and want to get married this year. we have tried so many solicitors which they give us different advises and we don't know whether they are correct or not. it's been a nightmare!!!

so far we gather all the advises that we should get married in hong kong and get a spouse visa afterward, would it be the best choice for us? will they refuse my application? we don't have a clue what to do at the moment and hope we can get some advised from you all to help us out!! thanks

please, give us some suggestion, thanks all!!!

You need to apply on form VAF4a. Are you both over 21?
You'll have to prove that the relationship is genuine, that you can financially support yourselves in the UK without claiming Public Funds,
and that you have adequate accomodation.
Marrying in Hong Kong is probably the most straightforward option.

thank you so much for your advise!! ya, we are both over 21 and we can prove that my fiance can financially support me etc.

do you think we need a lawyer to fill out the forms for us? one of the solicitors said we could use the legal aid but as far as we are aware that it is a public fund but she said it isn't! we just want to make sure the application fill in properly, otherwise we have to wait other 6 months to re-apply again, it is so complicated for us.

by the way, thank you so much!!

If you feel that your application is straightforward then you shouldn't need professional help. Have a look at the forms to see what documents you have to submit for the application. If you do decide to seek legal advice, make sure you use an Immigration Advisor who is OISC registered.

thanks for your reply again!!! why do we have to use an Immigration Advisor who is OISC registered? have you heard about the French & Co. Solicitors? is it good? we just don't know whether we should go for the legal help or not!

OISC registered advisors only specialise in Immigration Law and are monitored by their professional body. The solicitors you mention cover other aspects of law, not just immigration. I doubt whether you would qualify for legal aid for a spouse visa application.

Hi Good people

I know some us us are struggling with finances and some can't even get a job until they get a decision with their passports from the HO. Therefore, it is EXPENSIVE calling those 0870/0845xxxxxxxxx numbers that the Home office generally provides.
Don't give up, now you can call Home Office for free, just check out www.saynoto0870.com and you will be provided with a local 0208/0151/0161xxxxxx number where you can contact HO for FREE! The actual number is 01516725626. (But log on to www.saynoto0870.com and confirm for yourself)
Especially if you have a pay monthly home or mobile telephone contract. You can still call from a pay as you go mobile but the charge rate will be like you are calling your neighbour next door on any 0208xxxxxxxx number.
Good luck Razz (Please share with others if it works for you!)
