How Long Will it Take?? pls Help

Hi enquiring about my husband he was immigration absconder from 2001 initially he applied asylum and then he supposed to report to police station but he disappeared , I am british we are married 5 yrs and have a 4 yr old child . We recently got a solicitor who contacted ukba and he told ukba all the circumstances and they send a letter to the solicitor that his case is in case resolution and they have updated the system and they said they will decide all cases by 2011 . What he should do now , Is it worth waiting here or going back home to get entry . Please help thanks laura

i think its better waiting coz your hubby will be granted ILR since his case is a legacy case. you will also need to find out which CRT is dealing with your hubby's case so yu can push them. the more your hubby push his team the quicker the ILR. beleive me i have been there before

4444? What you mean push the case resolution team how can you push them even in the HO letter its says dont write to us or telephone us.

dont listen to wat the letter say. under legacy if you dont push yu dont get. ask anyone on this board who was granted unde legacy. they will tell yu the same

All the replies are full of b*****. Get a good solicitor and send a new application of your husband on your basis. If you hear any thing quicker its fine otherwise just file the case against HO. Good luck.

i think your reply if full of b***** ,i was in similar situation as her hubby so i know what i am talking about.you dont even need a solicitor if your case is a legacy case. a few people from this were in a similar situation so i hope they come forward .

Yes i was among all them people who had to wait for over a year but after pushing as suggested by 4444, believe me i had the good decision with in 1 month.

Do not need to spend money on solicitors for nothing.. It's your case so you must fight for it.

Write letters to HO, give them reasons why you think your hubby should be granted ILR.

If i push HO too much. They might take decision against him as he was a immigration absconder before thats what the solicitor said.

dont beleive what your solicitor says, so far i have not heard of any refusal under legacy unless someone has got criminal convictions. you will need to push your case. i was also am immigration absconder. your hubby has got stong family ties in the UK and i know he will be granted ILR under legacy. they will never take a decision against him unless he has got criminal convictions.

the only thing he done is drink drive will this be a problem

drinking and driving is a criminal offence. was he fined or send to prison

My husband is asylum and legacy case, we involved our MP who pushed home office as we also have a child together (I am british). Our solicitor is 'best in the area' but of no help and solicitors seem to be ignored by home office, whereas MPs are not. My advice is contact your local MP, ours has just got the home office to agree to expedite (fast-track) my husband's case on the basis that he has strong grounds to stay. Don't worry about the drink driving charge, it is only very serious issues they can use against him, such as drugs, violence, sexual offences etc. Also, if the ban is spent (no longer in force) that's even better. GOOD LUCK!

And drink driving is not very serious? Come on, a car in the hands of a person under the influence is a lethal weapon.

hi i am confused my husbands solicitor telling him not to approach home office through mp , he said that will put negative effect on his case. please advise what to do now. thanks.
