Health in Pregnancy Grant Claim

During visiting hospital for our expecting baby.. midwife asked us to sumbit "Health in pregnancy grant claim".
We are under HSMP and my extension is due on sept.
Are we entitled to claim it..or will it come under resource to public funds...

Who can get Health in Pregnancy Grant?
You can get the grant if all of the following apply:

you are 25 weeks pregnant or more your expected date of delivery is on or after 6 April 2009 you have been given health advice from a midwife or doctor you may not get the grant if:

you are subject to immigration control or you are not present, ordinarily resident or have a right to reside in the UK

Aha! I've found it! I think the answer is no (which is very annoying)

If you're subject to 'immigration control'
You may not be able to get the Grant if you're subject to 'immigration control'. This means either one of the following:

the Home Office says you have permission to stay in the UK (known as ‘leave to enter or remain’) but this permission is given to you on the grounds that you don’t claim some benefits, tax credits or housing help paid by the UK government (known as ‘no recourse to public funds’)
you need permission to stay in the UK - again known as ‘leave to enter or remain’ - but you do not have it

If you are subject to immigration control you might still qualify for the Grant as long as one of the following applies:

you are a family member of someone who is from the UK or another EEA country
someone is sponsoring your stay in the UK
you come from Algeria, Morocco, San Marino, Tunisia or Turkey and you are legally working in the UK
you are a family member of someone from Algeria, Morocco, San Marino or Turkey who is legally working in the UK and you live with them

When you're not subject to 'immigration control'
You're not subject to immigration control if any of the following applies:

you’re a UK national
you’re from the EEA or Switzerland
you’ve claimed asylum and you have been told by the Home Office that you can stay in the UK as a refugee
the Home Office has told you that you are allowed to stay in the UK indefinitely – known as 'indefinite leave to remain'
