Applying for IRL for my wife

Post by mooo » Tue Mar 31, 2009 11:56 pm

My wife settlement visa is due to finish on the 24 May. The visa was first issued on the 25 May 2007 but she arrived in the UK on the 7 August 2007. The reason for the delay in coming into the UK was her father was taken ill and was hospitalised for serveral months.
Can I still apply for IRL? I got supporting evidence which I am happy to supply with the application.
Or do I have to apply for an extension first.

Your advice on this matter is greatly appreciated

Yes. SET(M) postal application may be possible between 7 May and 24 May 2009.

If you apply by post before the visa expiry date, the application will be held on file until the date your wife would qualify...28 days before the 2nd anniversary of the date your wife first entered the UK on the visa.
Concession (relatively new) for postal applications only...due to the fact that spouse visas are now issued for 27 months not 24.

Hi,

Following on from this discussion, I'd just like to confirm a couple of things for my wife's ILR application.

The initial 2-year entry clearance visa is valid from 12/06/07, expiring on 12/06/09.

She entered the country on 20/06/07 and we have lived together since.

We have booked the application in person for 24/05/09.

We have an overseas holiday booked for 05/06/09 (I know, not the wisest thing to do but it's a big family reunion where choice of dates were out of our hands.)

Now, assuming everything goes smoothly will we have our passports returned to us on the day of the interview, and if so, will there be no problem for my wife to travel on 05/06/09?

My concern is that she won't have been in the UK for the full two years to qualify for the ILR until 20/06/09. Or if the application is made within 28 days of that date then they award the ILR with effect from the two year anniversary? Or will they hold the passport until the two year anniversary? (my main worry).

Any help would be much appreciated.

J

Thanks, I've already booked the appointment at the Croydon office for the 25th (not 24th as I stated).

My question is more in regards to what happens in regards to our passports - will we have them handed back to us on the day, assuming there are no complications? Two years is not up until 20/06.

If there are no complications, then she should receive her ILR on that day.
