If you apply for an extension, your visa expires and you have not received your extension. I understand this should not cause any issue.

But what would happen if Extension application is rejected after your visa expires?

Will one a get a chance to review or something or one will get a time-frame of few days?

2) When your visa is finally approved, what date does it start from, date of approval or date of last expiry?
Thanks for ur prompt response.
1) Yes - this is legally allowed.

2) If the visa has expired since the application was last submitted, the stamp is usually dated from just before the date of expiry, although this has occasionally not been the case.

Need advice regarding HSMP extention

Post by tatshri » Sun Mar 22, 2009 9:29 pm

Dear All

My case is a bit unique…I had applied for a HSMP visa in Feb. 2007 and got the HSMP approval in March 2007. Subsequent to that, I had applied for entry clearance and obtained the same which is valid until October 2009. I have not yet moved to the UK but planning to come to the UK in July 2009. I am currently working in Ireland.

Just wondering, would it possible to get the Tier 1, General Migrant 2 Years visa extension if apply for same, after reaching in the UK, before 5-6 weeks of current HSMP visa’s expiry. I am hoping to get the job in the UK but any case it would not be possible to earn 45K £ in the UK only in 3 months time to gain 45 points. Can I show my earnings of Ireland in this case and if yes then would it acceptable to the UK Border Agency? Will they extend my visa on the basis of Ireland (9 months) + UK (3 months) earnings?
Has anyone encountered such type of case, any suggestion in the regard will be highly appreciated. I look forward for your valuable comments. Thank in advance.

HSMP to Tier 1

Post by allgo » Sat Mar 28, 2009 7:13 pm

Hi friends,

I understand that the Tier 1 rules are going to change from 1st April. i.e. Masters is going to be mandatory. However those who are under older HSMP visa will be considered for extension on their older rules.

My questions are
a) I need to apply for extension in June, which is about 3 months before my current HSMP visa expires. I had heard of rumors like one can only apply for extension 5 weeks before expiry. Is this true? Or we can apply anytime?
Kindly note I will have to apply for switching to Tier 1

b) Do we need to send the documents like educational certificates , birth certificate and english language proof again ?? - those we had already sent for initial HSMP visa.
I have come up with the list below after some research -
1. form
2. 12 payslips
3. 1 year bank statement
4. 2 photos of specific size
5. Passport
6. HR letter (optional)
Assuming we don;'t send birth certi and educational proofs again

Can someone who has already applied recently please confirm.

3) Is the new Tier 1 form already available>?
I check this site
http://www.bia.homeoffice.gov.uk/workingintheuk/
is the above where the official form comes out?

Thanks in advance

Many thanks Yasa. That is encouraging.
It isn't for the age benefit but I need to be in India roughly 5 weeks before my visa expiry due family events and hence wanted to wrap up the extension application before.

Thanks again :-)

EXTENSION NIGHTMARE!!!

Post by khubs » Mon Mar 30, 2009 8:40 pm

Hi,

Pls. advise.....

I got hsmp visa starting feb 2008-feb 2010. i came to London in March 2008 and started working in June 2008 -currently working till June 2009(one year LIMITED CONTRACT)

By June 2009, I would have met the requirements for extension.

My question is can i apply in June 2009 and get extension stamped from Feb 2010 for three years.

This is because from June 2009(when my cuerrent job finishes), i will be left with only 8 months and minimum job contracts in my field(substance misuse) are for 1 year.

Pls. advise.....

THANKS IN ADVANCE!!!!

I wasn't very lucky.

Applied on 10 Jan 09 for an extension,
Got a letter back on 3 mar 09 requesting the policy registration
Resent everything back on 4 mar 09,
750p fee was returned. Don't understand why???

Keep chasing them to debit my account - no reply/no debit to my account

1Apr the caseworker advised she dispatched everything back to me on 31/03 but didn't say it is successful or not.

I called call centre to find out, and were told when you receive the letter you will know the answer. VERY VERY UNHELPFUL!!!!!!

To make it worse, I missed out the first delivery attempt and went to the local post office to collect and were told they couldn't find it.

So I spend all my day thinking the news is good or bad and where is my package.

Does anybody have similar experience? If HO doesn't charge the fee, they wont give you the visa?

I have got 3yrs extension and this supposed to be the last one before I am eligible for permant one. I've got a job and qualify for all the points.

I am feeling very frustrated and don't know what is coming?? :(
