ILR for UK born EU national child

Post by GoodFun » Thu Apr 16, 2009 12:02 am

Can someone please advise if it worth getting ILR for an EU national child. The child was born in the UK but is not a British citizen due to the parents being non-EU nationals.

I ask this because earlier dependents could be added free of charge on ILR SET(O) application but now there is a £50 charge per head.

As the child is an EU national, ILR is technically not required but I am not sure if there are any benefits of getting ILR along with parents as a dependent as the child can be registered as a British citizen once the parents get ILR.

How is the child an EU member state national if the parents are not? Is the child Irish?

Child can be registered as British as soon as one parent has ILR.

Irish citizens automatically have ILR under current rules/policy anyway, but that could change with the evolution of the Common Travel Area.

But it probably wouldn't hurt to include your child ... isn't your child also a citizen of your country?

Once you have ILR, you should register the child as a British citizen.

It is more a deconstruction than an evolution... but I think it has been stopped for the time being by the house of lords.

We are planning to register the child directly after we get our ILR in Jun/Jul this year. Our country does not allow for dual citizenship hence the child only has Irish citizenship.
