Choice for son above 18 years

Post by 315cool » Fri Apr 17, 2009 12:10 pm

Got HSMP Tier-1 (General) visa for self + wife and son (was below 18 years) in Dec-2008, which is valid till Dec-2011.

Now, son is above 18 years of age. The son has choice to study in UK or outside UK (for university education).

Question-1A :
The question is for the son's case - in order to have future extension (or continuity) of his "Dependent HSMP" visa and eventual eligibility for Permanent Residence or settlement for him, is it necessary for the son to stay in UK or study in UK universities ?

Question-1B :
If the son decides to study outside UK, will he be eligible to get the visa extension or Permanent Residence, when the HSMP main applicant (his father) submits the application for the visa extension or the Permanent Residence/settlement ? That is to say, can he visit only at the time of submitting visa extension application ?

Regards,

You might want to explore these questions with a good immigration solicitor.
