THIS IS THE CHANCE TO MAKE YOUR VOICE HEARD BY THE E.C.J

Post by alooma » Sat Apr 18, 2009 1:06 am

HELO FOLKS,

For those of us that have been going through hell from the autorities of any member state depriveing us of our free movement right, this is the time to have your say.

ECAS launches its hotline on how the EU Institutions and national authorities handle citizens’ complaints on free movement

There is a lot of debate in the Union about how to combat protectionism and zenophobia in the recession and guarantee the internal market freedoms. There is quite a debate in the Institutions about how to improve enforcement. However, as Alain Lamassure MEP points out in his recent report , no one bothers to ask the citizen. That’s where the hotline comes in.

The background document (accessible HERE http://www.ecas-citizens.eu/index.php?o ... 42&Itemid=) sets the scene. It argues that with the increase in available information, citizens expect that someone will deal with their problem. Expectations have increased because the European Court of Justice has made free movement a fundamental right of Union citizenship and there is a much improved legal framework. So rarely do we need new European laws.

Frustration comes from the gap between the case-law and the legislation and what actually happens on the ground. People are not made to feel like European citizens with national authorities often applying, not the spirit of EU law, but the exceptions.

What should be done? Do you or your organisation have experience of observing the application of EU law, sending complaints to the Commission, the European ombudsman or petitions to the European Parliament? How did you find the process in terms of ease of access, accountability, speed and results? Please email us at hotline@ecas.org(This e-mail address is being protected from spam bots, you need JavaScript enabled to view it ) with your story, and fill in the questionnaire found (HERE http://www.ecas-citizens.eu/index.php?o ... 47&Itemid=)

We would also be grateful if you could circulate the questionnaire widely in your network.

By collecting together the answers, ECAS will be able to add weight to the argument for the next European Parliament and the next Commission to show real political will not just to regulate, but to enforce regulation, and to put resources behind these efforts. The attached paper also argues that there is a need to strengthen the Commission’s powers of enforcement and create a European Commissioner for citizens and fundamental rights. The system of “infringementâ€

Hi Tobbe, long time no hear, hope all's going well?

FYI: All I got back from the >>petition<< so far is that it is in line with petition guidelines and will be dealt with...

Should there be a tangible outcome during our lifetimes I'll fill you in, of course. It's not forgotten ;)

@all - sorry for hijacking this thread

I’ve been fine, thank you. Been busy changing jobs etc (still stuck on the twilight islands though). I saw your post about the petition but at least they are having a proper look at it so hopefully something good will come out of it (around 2025?).

After several rounds with the commission and the ombudsman my petition ended up with “Yeah Spain certainly seem to be in breach of the directive but we can’t be arsed to do anything about it and as far as we are concerned that is the end of the matterâ€

Sorry of topic again,

I filed a complaint with the Commission.....have so far received 3 emails from them, first one just a confirmation, second asking for more information and informing me that my complaint was valid then nothing for months!!

I emailed, emailed and emailed them until I received another email stating that they had asked the Italian Government for clarifications on my case!! (I want more than bloody clariications want them held responsable)

I'm hopefull......but not much as my husband is stil without a RC and unable to work which is a nightmare!

I was just curious. I wasn't fully clear from the original message.
