Hello,

I have a friend who needs help and I can not really answer her at the moment, so I am asking here in the forum. Situation is as below;

She got married in her home country to a British Citizen (also same national as her). She was then issued a Spouse visa

Entry clearance: 08 Nov 2004 to 08 Nov 2006.
Entered UK: 22 Jan 2005
She has always been in the UK since then to date.

During 2006 leading to the end of her spouse visa, she was being abused and had to separate from husband. All this was detailed in police reports as well. She also had a little girl during this period.

By late 2007, I adviced her to apply for ILR under domestic violence as she in my thinking qualified, and by April 2008, she was given ILR indeed under DV.

Now where I am confused is, when does she qualify for Naturalisation? I have also told her to wait at least a year since April 2008 just to be on the safe side, but now that the April 2009 timeframe is near, I want to be sure she qualifies for BC before she applies.

Please advice.

Is she still legally married - or divorced?

Just separated... definitely not divorced

Being separated is no bar to applying for naturalisation as a spouse.

Does she have any proof of her spouse's British citizenship?

He will not leave his passport nor the details though.
