Switching to Tier 1 after Tier 2 is rejected

Switching to Tier 1 after Tier 2 is rejected

All, Is it possible to switch from within the UK to Tier 1 from Tier 2 if the Tier 2 extension gets rejected due to some reason and the current WP visa has expired before you come to know about the rejection ?
I know there is a right to appeal in this situation. But not sure if you can apply a fresh application when you have been given a right to appeal.

A quick response is highly appreciated.

If extension of Tier 2 is rejected but the current visa is still valid you can apply for Tier one (even if it's 1 day before your current visa expires). You can only stay in country after your visa is expired during the appeal process.

However if your current WP has expired then you will have to apply for Tier 1 from outside UK. Sorry about that and good luck.

Shucya, thanks for your reply. Any idea about what can be done in the appeal process. Like, can additional evidences be provided or new attributes applied. Say you filled something incorrectly or you now need to apply with a different option...

Any idea about the Tier 2 transitional arrangements ? What supporting evidences are required to be submitted with the application ? As per the quidance notes I could only see passport, photos, CoS reference number.

No additional evidence are allowed during the appeal process. You just respond to each and every ground of refusal and explain your position in more details. The possibility is that once they have made their mind they would stick to their decision (this was in my case anyway).
