Question on HSMP ILR JR

My HSMP letter is dated 3-Mar-06, although the HSMP stamp in my passport is as of 25-Apr-06.

The new 4-year ILR policy for HSMP has a cutoff date of 3-Apr-06.
Can someone advise me what this date refers to?
HSMP letter date (if yes, then I am covered!) or the date of stamp in passport?

My understanding (and I'm in the same boat as you) is it goes on the HSMP approval letter date (submission, not approval) and not on the date of the subsequent FLR or Entry Clearance.

Just one more point:
I came to the UK in Jan'05 on a WP, then applied and was approved HSMP in March '06.
Based on a reading of the relevant documents, it seems I am eligible to apply for ILR now?

Again you and I share a similar story. :) It would appear we both qualify based on our combined and consecutive WP & HSMP visas.

BTW: The HO document does not describe our situation precisely but I think it's close enough that it should not be a problem (and the HSMP Forum will be on their case if it is). The nearest they get to us is where they describe those who applied before April, got approval after April and applied for FLR / entry clearance on that basis. A small difference but the HO staff are not known for their wise and just decision making skills.

Are you on a Tier 1 visa issued according to the original HSMP JR?

My situation: WP Jan'05 > HSMP Mar'06 for 2 yers > HSMP extension in Apr'08 for 3 years

I do have a concern: the HSMP forum page cited states the following:
c. (2 + 3 ) - Initial HSMP Visa of 2 years & then received extension of 3 years

(Please note: this scenario applies only if HSMP application was made prior to 3 April 2006 because 2 years of initial HSMP visa started after 3 April 2006)
What does this mean? My HSMP approval letter was dated 3-Mar-06 (I got my stamp 25-Apr), but it was for 2 years, not 1 year.
Does this pose a problem?

My reading of this (not so well worded) part of the document is it exactly describes your situation:

You applied before 3 April and got approval ("HSMP application was made prior to 3 April 2006"). You then got your 2 year visa on 25 April ("2 years initial HSMP visa started [being issued] after 3 April 2006").

Happy to hear other interpretations.

hi, even though the new HSMP JR rules for settlement are out, i am bit under confusion, could someone answer my query, plz

came to UK on a work permit on june 2005
switched to hsmp on october 2005 ( 1 year visa)
got 4 years in oct 2006 extension until oct 2010


am i eligible for ILR/settlement on october this year ??

Based on responses here, I have gone ahead and booked a PEO appointment for ILR.
Now starts the process of preparing docs and keeping fingers crossed...
