Hi all can somebody please help me in having the following questions answered.
Im a a UK citizen and I currently tried to sponsor my in-laws for family visit they were turned down with the right to appeal. They have asked me to appeal to the AIT here directly as sponsor and representative.
I have no experience in appeals and the solicitors I have approached have quoted in excess of 600 to 800 pounds. Naturally I can think of better places to spend that money.
1. Should I get a solicitor to fight the appeal for me?
2. What’s the difference between the review and the appeal and can I submit new evidence in the review (examples given below). Do I need to fill in the appeals form for the review or do I just write to the relevant department?
3.I have savings of approximately £4000 but I am currently only in part time work and on tax credits. This was the one of the reasons they were turned down. What are the chances of a successful appeal when I am in receipt of public funds? Even though I can quite easily substitute my wages with the savings I have.
4.What do I actually need in savings to be able to maintain two people for 6-8 weeks? Plus what should I be earning in wages since I am well above the government guide lines for what is required and I have no rent or mortgage etc.
5.They were planning a longer visit but have cut down the weeks due to not getting a visa and being able to travel according to their preferred dates. Will a letter from them confirming their agreement to a shorter family visit be accepted at this stage?
6.Can new evidence that was not mentioned in the application or initial sponsors file be submitted now? I am the sponsor and my father offered to accommodate them at our main family home. Can my father also agree to pay for their tickets at this stage? Or will this not be accepted now.
7.I have strong family support and they are willing to help with the maintenance of my in-laws can I mention that at this stage. And will their savings and declarations be sufficient or do I need wage slips for them too.
8.I sent a signed declaration stamped by a solicitor with the initial sponsors file do I need to do the same for the appeal.
9.Can I submit copies of new evidence for the review/appeal since getting the originals from India may take too long or loss damage in post etc.
10.Where can I down load a appeals form to use the AIT website says theirs is just for information purposes.
11.Can I email the appeal and review files or fax them.
12. can I send the appeal form first before the 28 day period then get the files to them at a later date.
13. Should I just mention answers to the questions raised in the refusal letter. Or can the VCM object on grounds they did not mention in the refusal letter.
14. Any advice on appeals strategy format of documents etc would be appreciated.
