Am I eligible for ILR?

Post by ughosal » Sun May 31, 2009 12:03 am

Hello all, I wish to know if there is any chance that I can get an ILR. The following is my situation:

1. Feb-2003 to Jun-2007 in UK on Work Permit visa with a total of 183 days stay out of UK with a maximum of 48 days at a time.
2. Followed by 154 days in India. Work Permit expired during this period. Acquired HSMP from India during this period.
3. Feb-2008 till now in UK on HSMP visa, with a total of 79 days out of UK, 60days being the maximum at a time.

Any guidance will be much appreciated. Thanks.

My advice is to go to any company / solicitor that applies for ILR for you at a charge. Type ILR application in google and you will get plenty of names. There are many who do no win no fee kind of ILR applications for you. They will assess your case and let you know if you are eligible before charging you for anything. They won't be willing to file for your ILR if you are not eligible.
So that will tell you for sure if you can apply and get a good legal support too later if you wish to apply through the solicitor / company

Personally I do not think you stand any chance - the visa continuity has been broken. A case worker will be able to clearly see that.

You are not.. for the reason in bold.

here is my case:

I got WP in UK in July/Aug 2004 (5 years).
27 Feb 2005 resigned from UK Job and joined Indian commpany in India.
Came back on new WP on 31 May 2005 (Total gap 90+ days).

Checked with HO and comformed that my ILR counter has been reset because of my time out of country in 2005 and will have to wait untill May 2010 ....
