tier 1 extension refusal, urgent help

tier 1 extension refusal, urgent help

Hi,

My friend's Tier 1 extension application rejected due to maintenance funds requirement. He had to keep 800 + 2*533 = 1866 pounds in his debit account, because he has 2 dependants. however his money was in savings accounts and he forgot to add savings account bank statements.

His HMSP expired in 29th of May. He applied for extension on 14th May.
As far as I know, he can't send additional documents with appeal form.
He also can't apply again in the country because his hsmp expired.
Does he have to go back to Turkey and do a fresh Tier 1 application (which means he will have to have Masters degree and all)?

Or is there another way? has anyone sent additional document with appeal form? Or has anyone had similar experience?

I would get legal advice on this one. The letter of the law, as far as I'm aware, would insist that new evidence must not be submitted. However, there are frequent case-reports on this site of people submitting additional evidence and getting away with it, so there may be a valid legal precedent to use.

My friend sent me the details on his appeal form. It says:

"You should not appeal on grounds that do not apply to yourself. You should also give arguments and any other supporting evidence, that justifies your ground."

I guess this means he can send new evidence.

in this page, it says "You should not send any additional documents with your request for a review." for the people applying outside UK.

I guess inside UK, there are different rules, which I am just trying to clarify.

I also advised him to go to a lawyer.

Submit additional evidence. Others have done it successfully - search the board and you will find the relevant posts
