Tier 1 Refused....Urgent help needed by seniors please......

Tier 1 Refused....Urgent help needed by seniors please......

Hi,
I recently have been refused for Tier 1 G.In refusal letter all the points have been awarded except previous earning because HO couldn't verify them though my previous employer had received a call from BHC and he did confirm all the details BHC wanted to check.

just to clarify my previous earnings were from home country!

Don't really understand why HO says they coudn't verify them now when they have contacted my employer?

I have been given the right to appeal as my visa has already expired.
I will be going to lodge the appeal,any help or suggestion would be highly appericiated.

Current VISA expired, Right to appeal - suggest in country application.

Just a few questions.......
Did you apply from UK or from home country?

Applied in UK back in mid march 2009
Get a letter from your employer which states (1) what your employment details are, (2)that they were contacted by BHC on xxx date and confirmed the details &(3) that they are happy to confirm the details if someone from HO/BHC wants to spk to them/ enquire through letter/email

This might be useful.

one more question please,

just in case if God forbid appeal doesn't go well then would I be able to appeal in any other court against the decision since I believe I've provided all the required documents and verification was fine as well?

No,thats what making me so confused because if HO was not happy with the verification(didn't seem genuine to them) they should have refused it for deception reasons not for unable to verify?

ASK UR EMPLOYER WHAT VERIFICATION HE HAS PROVIDED ! MAY BE THERE IS DIFFERENCE IN ANY THING WHICH YOU HAVE PROVIDED IN APPLICATION FORM AND THE ONE WHICH THEY GOT FROM YOUR EMPLOYER !

Already have confirmed that.All the information provided has been accurate & I think(as have seen couple of cases) that if information doesn't matches then HO refuses the case for deception reasons.

if you are 100% sure about the docs you have provided then according to one solicitor you can challenge their decision.

there are lots of cases people are challenging their decision but having positive grounds. But i know one more thing there is some reason for which the case worker has refused your case. If any loophole in your docs then i would say you are wasting your time & your solicitor too + money as well

So before challenging their decision just go through again on your documents.

BCH has just called your employer or they have taken written reference ?

just a phone call..

I dont think so there is any other problem in the case....atleast I can't see and points have been awarded to all other sections...

which other reason do you know for my refusal??it would be quite helpful to prepare for appeal!!!

they usually take written reference. There is some thing from which case worker was not satisfied.

Your employer should ask him to send written reference.

I have heard with so many of my friends who did case
from home country. Mostly employer say BHC didn't contact them and some lie that they did replied.

I advise you consult immigration solicitor. he might need written from your employer and then you can appeal against their decision.0

Thanks for that.
One thing is for sure employer isn't lying about verification.
I had submitted employment letter with my application as well and I'm going to get a new ref letter stating that he had verified all the details over the phone (as advised by push_hsmp) when called by some one from BHC.

ask solicitor what letter he required for the appeal.

dont get the letter that he have verified BHC and submit. Prepare the case first.
