Is COA required?

Hi Guys,

I have recently got my ILR.

I am married 3 months now (prior to getting my ILR). My wife has been in the uk for the last 4 years on workpermit. We got married in India.

But 'coz we live in different places in uk and that she is on work permit, she could'nt move to stay with me. We have waited to get My ILR. Now that I have my ILR, we would like to apply for spouse visa for her so that she can move.

When i was going through the UKBA website, i have noted that certificate of approval (COA) is required to marry some one under immigration control.

Do you think I should have applied for COA? is COA required in our case?

I didn't realise I had to take permission from UK to marry some one I like.

And also is in-country switching possible from WP to spouse visa?

Please let me know what is the best course of action.

We got married in India.
As well as possibly being a religious wedding, was it also a legal marriage?

it was religious and Legal. We have the marriage certificate to confirm that. And the certificate was issued in english.

Hope it shud be OK.

If it was a valid marriage, then she does not need to marry again. She may switch to FLR(M) (285) and subsequently apply for SET(M) (288). However, it may be quicker for her to wait and apply for SET(O) (134) as a work permit holder, if she still qualifies.

The CoA applies only to people getting married in the UK.

And the UK recognises as legal marriages that are legal marriages in other countries.
