ILR -- days outside

Post by magic2009 » Wed Jul 29, 2009 4:22 pm

Hi everyone,

I have read through some posts with regards to the calculation of the number of days outside the UK. I am talking about ILR through 10 year long residency. during the 10 years, 18 months is the maximum allowed time outside the uk .

I am really confused now, some say weekends and bank holidays are excluded, others say they are included.

Anyone can confirm this to us (whether weekends and bank holidays are included or excluded in the count)

Thank you in advance

Thanks racingfire for your reply.

is it written somewhere in the guides, or just from people's experiences.

They are included.
You can categorize them if you like but they are still an absence. Full stop.

Gobalgypsy in your case by how much do the weekends and public holidays take you over the threshold. It could very well be that it didn’t make a difference. Remember also that the caseworker may have used some 'discretion' which is something you cannot always count on. I am yet to read anywhere in the official documents where it says you can exclude weekends or bank holidays

If I had included weekends and public holidays, the days absent would have gone up to >190 days.
If you read thru the cited email exchange I quote above, you can get an idea of Home Office thinking on this topic.
