Do dependents need 2 year residence for ILR ??

Post by rashidshah » Fri Aug 14, 2009 9:34 am

Hi all , Can anyone answer this question please .
Is the 2 year requirement for those dependents ONLY who are applying independently using SET(M) OR
Is that 2 year requirement also for dependents on a SET(O) form ?

it depends on which category u r applying??

if under hsmp ilr then the status of the main applicant will be the status of the dependent

no 2 years qualification period required for hsmp

pls put through more details about dates and visa under which u r querying?

Pahini,

Does this mean that if one has Tier 1 and will become eligible for ILR five months later then the dependant who joins him/her in the UK now can get ILR along with the main applicant ?

Vinny,

Thanks for your response, but any idea if the minimum 2 years requirement needs to be continuous 2 years or can these be cumulative ? For example, 18 months as dependant, then few years not as dependant and then again 6+ months as dependant before applying.
Has anyone in the forum got ILR for partner based on the above example ?
