overstayer and confused!

could someone throw light on this please?My mate who is an african is on 2 years post study permit to work.He is living together with his girl friend who is illegal immigrant, also an african,and they both have a baby together who is nearly 5 months.They are comtemplating of going back to Africa and apply for spouse visa. Is there any chance for them to be successful,as his girl friend is an illegal immigrant? I learnt that spouse visa is exempted from the rules that forbids illegal entrant from applying for visa outside the UK.Does it apply to the sponsor under the immigration rules? Thank so much!

Spouse of PSW holder is not exempt from the ban.

thank you so much for your response. my question now is, what about if they 'r able to marry in England and go back to thier home country to apply for spouse visa while leave the baby behind in England?Is there any chance to be considered even with the evidence that she has got a baby in England? thanks for your advice.

A child is the responsibility of its parents. I don't see how one can expect to be taken seriously with the thought that leaving a child behind would act as leverage for their return to the UK!

Apart from the above, any substantial reason why they wish to leave the child here?
