ILR JR /Naturalisation question concerning dependant

Post by mimimt » Sat Aug 29, 2009 6:19 pm

Hi All, my colleague currently has a WP. Her husband (they got married this March) is on HSMP/Tier 1 and will benefit from JR. As WP is not covered by JR, my colleague's thinking about switching to her husband's Tier 1's dependant so that she can get ILR one year earllier. The trouble is she has to go back to South Africa to switch from WP to Tier 1 dependant.

Her husband naturally will be able to naturalise 1 year after obtaining ILR. My question is when will my colleague be able to naturalise? Will her time spent on WP count towards 3-year qualifying period for naturalisation as a spouse of British citizen, or will her 3-year period only start from the day she becomes a dependant on her husband's Tier 1?

Also, her husband studied for a year and a half on HSMP extention period (so not the initial 1-year period), will their ILR be refused for this reason?

Thanks

Time spent on WP will count.
