It says:
Statistics show that 30 per cent of the cases dealt with by the Government's Forced Marriage Unit involved victims aged between 18 and 21.
Every sentence starting with "Statistics show" makes me suspicious, and this is no exception. My wife remarked: "well, then clearly 70 per cent of the cases are over the age of 21, so they should rather ban marriage visas for spouses over 21 than under". And I would take her logic over the reasoning of the Home Office any day.

Are there any bets whether this will stand in court? I assume they are smart enough to exclude cases under European law, because that would clearly not convince the ECJ.

Living in the UK as a spouse or partner wrote:10 December 2008

...As a limited concession, the change in minimum age to 21 will apply only to cases where the UK-based sponsor is present and settled in the UK, or is being admitted for settlement on the same occasion as the applicant.

The minimum age of 18 will continue to apply to sponsors and their partners in those cases where the stay of a sponsor is subject to a time-limit (for example, students, work permit holders).
Lower age limit for partners of points-based system applicants wrote:21 August 2009

The UK Border Agency has clarified the age requirements for husbands, wives and civil partners under the points-based system (PBS).

To be allowed to enter the United Kingdom as the husband, wife or civil partner of a PBS applicant, the dependant and the main applicant must both be aged 18 or over on the date when they are due to arrive in the United Kingdom.

Paragraph 35 of the policy guidance for PBS dependants has been amended to include this clarification. You can download the revised policy guidance from the right side of this page.

Spouse and partner visa concession wrote:anyone refused on the basis of being between the ages of 18 and 21 who can show they are not party to a forced marriage (which is pretty easy to do!) has a very strong case based on human rights and discrimination law.

Forced marriages are appalling and a very serious issue, but this is not the way to deal with the problem. It is disproportionate and disingenuous.
