A spouse visa is a settlement visa as that is the intention is to settle. The bottom line is if the marriage is not subsisting, then report it to the HO and let them due their adminstration. If the ******* want to leave the country and the HO hasn´t updated the database, then it is on them. What is on you, the sponsors, is to report the fraud or deception.
