home office tier 1 calculator is giving incorrect scores

home office tier 1 calculator is giving incorrect scores

Hi

I recently used the home office tier 1 points calculator to assess my points for a tier 1 extension.

It is showing 20 points for someone who is 30 years old at the date of application. On the policy guidance this should be 10 points.

Is that just blatently incorrect, or am I missing something???

I think I've worked out the problem. The calculator assumes everyone applying for an extension is already on a Tier 1 but the points awarded for age are different for those on a hsmp visa wanting to extend to tier 1.

There are only two possible scenarios- either you are
1. Switching into Tier 1 as new applicant or
2. Extending leave under Tier-1.

Those who have HSMP and wish to extend their leave fall under category (2) above.

Others with leave to remain in any other category, e.g., Work Permit, etc fall under category (1).

This is from the policy guidance:
Claiming Points – Extension Applications only
Applicants should note that the available points for age differ at extension stage depending on whether the individual’s previous grant of leave in the United Kingdom was under Tier 1 (General) or the Highly Skilled Migrant Programme (HSMP).

Extension Applications – Tier 1 (General) Migrants, self-employed lawyers and writers, composers and artists
An applicant who is already in the United Kingdom under Tier 1 (General), the self-employed lawyers concession, or the writers, composers and artists provisions of the Immigration Rules and is using the extension requirements of Tier 1 (General) can claim points as follows:

Under 31 years of age: 20 points•
31 or 32 years of age: 10 points•
33 or 34 years of age: 5 points•

To claim these points, applicants must fall within the age bands specified on the date of their application.

Extensions Applications – Highly Skilled Migrants
If an applicant is currently in the United 67. Kingdom as a Highly Skilled Migrant and is therefore applying using the extension requirements of Tier 1 (General), they can claim the following points on the basis of their age:

Under 30 years of age: 20 points•
30 or 31 years of age: 10 points•
32 or 33 years of age: 5 points•
To claim these points, applicants must fall within the age bands specified on the date of their application


The points calculator does not cater for the "Extensions Applications – Highly Skilled Migrants" Scenario!

I just checked the PBS calculator and have entered the following:
Tier: Tier 1(highly skilled worker)
Cateogry: Tier 1(General)
Applying from: Inside UK
Type: Extending your stay in UK
Are you in UK with permission to stay as highly skilled migrant: Yes
Age: 29 years

Was awarded 20 points and this tallies with the guidance notes. What is the confusion?[/img]

try it again with an age of 30, it will automatically give you 20 points, not ever asking you if you are currently on HSMP or Tier 1.

On the first page, you will see below question:
What type of application are you making? Switching/Extending

If you answer extending, then you see the below question:
Are you in UK with permission to stay as highly skilled migrant: Yes/No
If you answer yes then it means you are currently on HSMP, if you are answer no, then it means you are under Tier 1.

On the next page you have to enter your age which is awarded as follows:
Extension Applications – Tier 1 (General) Migrants, self-employed lawyers and writers, composers and artists
Under 31 years of age: 20 points
31 or 32 years of age: 10 points
33 or 34 years of age: 5 po

Extensions Applications – Highly Skilled Migrants
Under 30 years of age: 20 points

Calculator is working just fine, I think you are not entering the details correctly or have misunderstood. [/b]
