hello guys

ples dose any body ve any idea,what kind of check dose the eco make on settlement apllications and how long can it take for them 2 do those check?
am asking this question cos i ve applied for a spouse visa since 8 of august with the british consulate in madrid and still not heard anything,i went there last week and they said they are still waiting for some check 2 come thru b4 they can make a decision.pls any info will be appriciated.

Did you choose to have an interview? When my husband applied for a settlement visa in Madrid it was granted on the day.
Did you submit marriage certificate, proof of the relationship, bank statements, proof of adequate accomodation in the UK, and your spouses finances. Madrid ECO's also request to see your 'Vida Laboral'.

i did sumit every thing they required,3months bank statmt,acoomodation,wife wrk conc,pay slip,photo etc,so i wonder why mine is takin so long.i summited my appl in augst9 and the eco rang me a wk later and ask sme question which i answered and he said i will here from them,but still no answer other than,we r still waiting 4 some check 2 come thru.did u apply for a spouse visa or a family permit?

Spouse. We couldn't apply for family permit under EU rules as I wasn't working in Spain. You've applied for Spouse?

We applied in April 2006. We married in Spain where we were both living.
Husband's Moroccan and had Spanish residency.

we got married in the uk and i was living there ilegally 4 5yrs b4 we move 2 spain.but i ve a legal status in spain now(resident card for family member of eu citizen)so i dont knw if that why mine is taking so long 2 dicide?

Probably. You hadn't considered applying as family member to return to the UK under EU rules? They tend to be more flexible.

no i didnt apply for a family permit cos my wife did not work in spain.but am not sure if it would ve been possible for me 2 apply for it,do u ve any idea abt that?

I believe you'll find that in order to return to settle under EU regulations (using Surinder Singh ruling) your wife would need to have been 'exercising her treaty rights' in Spain, by working, studying, or by proving self-sufficiency. There are other members with more knowledge on this route. You wouldn't qualify under your own rights as you're not an EU citizen.
Regarding your present application for a spouse visa, did you just 'overstay' a visa in the UK previously, or did you enter illegally or work under false documents? Not judging you...just trying to get a clearer picture.

OK. Have you been asked how you entered? Did you work with false documents? Passport? I'm trying to see it from the ECO's viewpoint, as much as I'm able to.

I think you misunderstood me. I meant did you work under false name or documents in the UK, not Spain...although maybe you do mean in the UK. You need to be aware of 320(11) in the UKBA regulations where you can be refused for false identity etc.
Hopefully, they're just routine checks which won't uncover anything negative for the application.

Sorry I don't, but they may well be looking into your time in the UK.
Have they asked how you entered the UK? Did you marry with a Certificate of Approval from the Home Office, or without one in a Church of England?

Hi alooma,

this is exactly what they did to me when i was enquiring about the visa situation they said they were doing checks......my husband had previously overstayed.....i would imagine they are doing some checks on you ie, background checks which take a few weeks to complete,,,there is something on the website i shall try and find it, although i think the literature is regarding referral and defrrals etc...but my husband did not apply from the same post as yourself...
